Terms and conditions — day rides

These terms apply to guided one-day motorcycle rides. Multi-day trips are subject to specific terms provided before any booking. Please read them together with the “Acknowledgement of Risk and Limitation of Liability”, which is presented to you before any payment.

1. Who we are

Cape Ride Adventures is the trading name of Click Capture Studio (Pty) Ltd, a company registered in South Africa under number 2020/522387/07, with its registered address at 3 Basswood Road, Kraaifontein, Cape Town, South Africa. Directors: Andrea Quintana Diaz and Mathis Marvin Quintana Diaz.

Contact: info@caperideadventures.com — phone and WhatsApp: +33 7 67 20 26 59. See also the legal notice.

2. The service

We organise guided motorcycle rides from Cape Town, as private rides or shared departures. You ride the rented motorcycle yourself. Each ride’s description (duration, level, type of roads, inclusions and exclusions) appears on its page and in the written proposal we send you.

The route may be adjusted on the day for safety, weather, traffic or site-access reasons, keeping the spirit of the ride as far as possible.

3. Prices

Prices are shown in euros, per rider. They include the items listed as included on the ride page and in the proposal, including motorcycle rental. Click Capture Studio (Pty) Ltd is not registered for VAT: no VAT is charged. The total price, deposit, balance and its exact due date appear in the written proposal.

4. Booking

  • You send an enquiry (form, email or WhatsApp). It does not commit you, nor does it confirm our availability.
  • We send you a written proposal: ride, date, total price, deposit, balance and due date, inclusions and exclusions, and our rental partner’s terms (age, licence, security deposit, excess, insurance exclusions).
  • You accept these terms and the risk document online (unticked boxes). We record the date, time, booking reference and the version of the documents accepted.
  • Your booking becomes firm once we have received the deposit and sent you our written booking confirmation. Until then, neither the date nor the motorcycle is guaranteed.

5. Payment

  • Deposit: 30% of the total price, on booking.
  • Balance: 70%, no later than 15 days before the ride date. The exact date appears in the proposal and in the confirmation.
  • Bookings made less than 15 days before departure: full payment, after our written confirmation of availability.
  • Payment by bank transfer to Click Capture Studio (Pty) Ltd, using the details shown on the invoice. If you receive a message announcing a change of bank details, check with us by phone before paying.
  • Balance not received: we send a written reminder a few days before the due date, then on the due date. If payment is not received within 3 business days after that second reminder, we may cancel the booking; the cancellation charges in section 7 then apply as at the date of that cancellation.

6. The motorcycle

The price includes motorcycle rental: we book and pay for it on your behalf with our rental partner. On the day of the ride, you sign the partner’s rental agreement and pay the security deposit it requires directly to the partner. Its terms (age, licence, security deposit, excess and insurance exclusions) are provided with the proposal, before any payment.

Models shown on the site are examples of the category booked. The model is confirmed before booking, subject to the partner’s availability.

7. Cancellation by you

You may cancel at any time, in writing (email or WhatsApp). Cancellation charges are capped as follows, depending on when we receive your cancellation:

Cancellation receivedMaximum charge
30 days or more before departureNo charge
15 to 29 days before30% of the total price
7 to 14 days before50% of the total price
Less than 7 days before, or no-show100% of the total price

Within these caps, the charge retained does not exceed a reasonable amount, taking into account the notice given, costs actually incurred and not recoverable (in particular motorcycle rental), costs we avoid and the possibility of offering the date to another customer. We deduct any refund or credit obtained from our partners. The same cost is never charged twice.

No charge applies if you are unable to take part because of your death or hospitalisation.

You may transfer your booking to a person who meets the participation requirements, subject to the rental partner’s agreement.

Refunds due are paid within 14 calendar days.

8. Weather, changes and cancellation by us

Less pleasant weather does not automatically lead to cancellation: we run the ride when it remains reasonably safe, adapting the timing or route if needed. We will never ask you to ride in dangerous conditions.

If we cancel before departure (dangerous weather, inability to provide the service, force majeure), you choose: postponement to a date agreed together, subject to availability, or a full refund of the amounts paid to our company for the cancelled ride. No credit note is imposed on you. Refunds are made within 14 calendar days.

If we must change an essential element of the ride before departure (date, main route, motorcycle category), you may accept the change or cancel free of charge with a full refund.

Interruption after departure: if the ride must be stopped for a safety reason not attributable to you (weather, road conditions, a breakdown not caused by your riding), we refund the part not provided, pro rata, or offer to complete it on another date. If the interruption is caused by your conduct (failure to follow safety instructions or traffic laws, dangerous riding, alcohol or drugs, invalid licence), the part not provided is not refunded, except for costs we avoid.

These rules do not limit your rights under the law.

9. Participation requirements

  • Be at least 25 years old and hold a valid motorcycle licence recognised for riding in South Africa (international permit if required), and meet the rental partner’s requirements.
  • Have riding experience suited to the motorcycle and the route. Complete beginners are not accepted.
  • Wear the equipment provided (helmet, jacket, gloves), as well as sturdy long trousers and closed shoes.
  • Do not ride under the influence of alcohol, drugs or medication affecting alertness.
  • Take out, at your own cost, personal travel insurance covering riding a motorcycle of the planned engine size, medical expenses and repatriation. We may ask for proof.

We may refuse departure to, or stop the participation of, anyone who does not meet these requirements or endangers their own safety or that of others.

10. Risks and liability

Riding a motorcycle involves risks. They are described in the “Acknowledgement of Risk and Limitation of Liability”, presented before any payment and accepted separately.

We are responsible for the proper performance of our services in accordance with the law. Nothing in these terms excludes or limits our liability for gross negligence or wilful misconduct, or where the law prohibits such exclusion. Each participant remains responsible for their own riding and for complying with traffic laws.

11. Photos

Professional photos of your ride are included unless otherwise stated on the ride page. They are delivered within 48 hours of the ride.

We only use photos in which you can be identified for promotional purposes (website, social media, marketing material) with your separate and optional consent, which you can withdraw at any time for the future.

12. Complaints

Write to us at info@caperideadventures.com or on WhatsApp at +33 7 67 20 26 59. We acknowledge receipt within 5 business days and reply in substance within 15 business days.

If the dispute is not resolved, you may contact the Consumer Goods and Services Ombud (CGSO) or the National Consumer Commission in South Africa, or the competent bodies in your country of residence.

13. Personal information

See our privacy policy.

14. Governing law

These terms are governed by South African law. If you are a consumer living in another country, this choice does not deprive you of the mandatory protections granted by the law of that country where it applies. Any dispute falls under the competent courts according to the applicable rules, without prejudice to your consumer rights.

If the French and English versions differ, the interpretation most favourable to the customer prevails.
